Following several years of consideration, the European Commission (EC) has banned the following fragrance allergens:

  • 3- and 4-(4-Hydroxy-4-methylpentyl) cyclohex-3-ene-1-carbaldehyde (HICC) (CAS NO. 51414-25-6/ 31906-04-4)
  • 2,6-Dihydroxy-4-methyl-benzaldehyde (atranol) (CAS NO. 526-37-4)
  • 3-Chloro-2,6-Dihydroxy-4-methyl-benzaldehyde (chloroatranol) (CAS NO. 57074-21-2)

The EC first considered adopting the Scientific Committee on Consumer Safety’s (SCCS) opinion, SCCS /1459/11, concerning the high number of allergy cases connected to these fragrance allergens, in 2012. They have now been banned under Regulation (EU) 2017/1410, which will come into force on August 23, 2017.

HICC is currently regulated in entry 79 under Annex III to Regulation (EC) No. 1223/2009. The regulation states it must be declared on the list of ingredients when its presence exceeds 0.001% in leave-on products and 0.01% in rinse-off products. Currently, atranol and chloroatranol, extracts from oak tree moss and tree moss, are neither restricted nor prohibited.

Stakeholders are advised to check their products comply with the new regulations, which come into force on August 23, 2017. They should phase out the use of these fragrance allergens in line with the compliance dates set out in the regulation:

  • August 23, 2019 – only cosmetic products which comply with the law can be placed on the market in the EU
  • August 23, 2021 – no product containing these allergens can be made available on the EU market
